These terms cover the use of this website, our text message program, and the general terms on which Ditmore Enterprise LLC (“Ditmore,” “we,” “us”) places vending machines. A signed placement agreement, where one exists, takes precedence over anything on this page.

Our service

We place, stock, service, and maintain vending machines at host businesses in El Paso and Eagle Pass, Texas, at no cost to the host. The host provides floor space and an electrical outlet. We own the machine and remain responsible for delivery, installation, restocking, change, servicing, removal, and any technical issue.

Location partners

• Placement is subject to a written agreement between Ditmore and the host business.
• Revenue or profit share is set out in that agreement. Our standard offer is 10% of net profits from the machine, paid monthly.
• Product selection and pricing are set by Ditmore in consultation with the host, at rates consistent with standard retail vending. We will not stock anything the host deems inappropriate.
• We handle all customer refunds directly, at no cost or administrative burden to the host.
• Either party may end the arrangement on thirty (30) days’ written notice.

Text messaging program

How you opt in

You receive these messages only if you gave us your mobile number and agreed to be contacted by text — when you were onboarded as a contractor, or when you asked us to reach you by text as a location contact. We do not buy, rent, or otherwise obtain phone numbers from third parties, and agreeing to these terms by itself is not consent to receive text messages.

Frequency, cost and controls

• Message frequency varies and depends on how often a job arises. In normal operation this is fewer than 10 messages per month.
• Message and data rates may apply. Your mobile carrier’s charges are your responsibility.
• Reply STOP at any time to end messages. You will receive one confirmation and nothing further.
• Reply HELP for assistance, or contact us using the details below.
• Carriers are not liable for delayed or undelivered messages.
• Supported carriers may change without notice. Delivery is not guaranteed.

Website use

Information on this site is provided for general reference. Product availability, pricing, and machine specifications may change. Submitting the contact form does not create an agreement; it is a request for us to get in touch.

Liability

Ditmore is responsible for damage or injury caused by its machines. A host business is not liable for damage or injury related to a machine, except to the extent it arises from that business’s own negligence. Nothing in these terms limits liability where the law does not allow it to be limited.

Disputes

We will try to resolve any dispute through good-faith discussion first. If that does not work, the parties agree to mediation or arbitration in El Paso, Texas. These terms are governed by the laws of the State of Texas.

Changes

We may update these terms. The date at the top of this page shows when they last changed.
