Ditmore Enterprise LLC places and services vending machines in El Paso and Eagle Pass,
Texas. We send operational text messages to the independent contractors who restock those
machines. This page documents exactly how that consent is collected, for review.
There is one opt-in method, and only one. Consent is collected in
writing, on the Independent Contractor Agreement, at the point a contractor is onboarded.
We do not use website forms, keywords, QR codes, or verbal consent, and we never obtain
phone numbers from any third party or purchased list.
The opt-in workflow, step by step
A person applies for restocking work and is offered a contract.
We give them the Independent Contractor Agreement — on paper, or
as a PDF they sign electronically.
Section 4 of that Agreement is a standalone text-message consent
block, separate from the rest of the contract. It is shown in full below.
To opt in, the contractor must take three affirmative actions in that section:
tick the checkbox, write their mobile number, and initial beside it.
Leaving Section 4 blank is allowed. The Agreement is still valid, and the contractor
is still offered work. Consent is not a condition of anything.
Only after a signed Agreement with Section 4 completed do we enter that number into
our system.
The first message that number receives is a confirmation of enrollment, which names
the brand, states frequency and rates, and gives opt-out instructions.
What the contractor sees and signs
Section 4, reproduced exactly as it appears on every Independent Contractor
Agreement we issue.
